Bombay High Court

SHREE SAI BABA SANSTHAN TRUST SHIRDI THROUGH ITS ADMINISTRATIVE OFFICERversusTHE STATE OF MAHARASHTRA AND OTHERS

Disposal
DISPOSED OFF

Holding

The High Court held that it has jurisdiction to order implementation of the Trust's resolution and allowed the civil application.

Summary

The Shree Sai Baba Sansthan Trust, Shirdi, through its Chief Executive Officer, filed a civil application seeking a court order to implement Resolution No. 206 dated 29.03.2025, which authorizes the purchase of four new school buses for its English Medium School at an estimated cost of Rs.1,38,24,752. The resolution was passed by the Trust's ad hoc committee under Proposal No. 51. The State of Maharashtra and other respondents opposed the application, arguing procedural and financial concerns. The Court examined whether the civil application was maintainable and whether the resolution required judicial intervention. Finding no impediment to the Trust's procurement plan and noting the public interest nature of the case, the Court allowed the civil application as per the prayer clause. Consequently, the Trust was directed to proceed with the purchase of the buses.
