Bombay High Court

SHREE SAI BABA SANSTHAN TRUST SHIRDI THROUGH ITS CHIEF EXECUTIVE OFFICERversusTHE STATE OF MAHARASHTRA AND OTHERS

Disposal
DISPOSED OFF

Holding

The Court held that there is no legal impediment and therefore directed the implementation of the resolution as sought.

Summary

The Shree Sai Baba Sansthan Trust, Shirdi, through its CEO, filed a civil application seeking a court order to implement Resolution No. 269 dated 09.05.2025, which authorizes an e‑tender for constructing a shade for a centralized laundry unit and purchasing new laundry machinery estimated at Rs.5.77 crore. The resolution was passed by the Trust's ad‑hoc committee under Proposal No. 42. The State of Maharashtra and other respondents opposed the application, arguing procedural and fiscal concerns. The Court examined whether any legal obstacle existed to directing the implementation of the resolution. Finding none, the judges held that the civil application could be granted as per the prayer clause. Consequently, the Court ordered the respondents to comply with the resolution and proceed with the e‑tender process.

Issues considered

  • Whether the High Court can direct the State and other respondents to implement the Trust's Resolution No. 269 for e‑tendering and procurement of laundry facilities.
  • Whether any statutory or procedural impediment exists to granting the relief sought in the civil application.
