RAMBHAU ROHIDAS JADHAV AND ANRversusTHE STATE OF MAHARASHTRA THROUGH THE COLLECTOR JALNA AND ORS

Disposal
Admitted/Allowed/Granted/Rule Absolute

Holding

The Court condoned the delay conditionally, denying the petitioners any interest or statutory benefits for the delayed period.

Summary

The High Court of Bombay, Aurangabad Bench heard a series of civil applications (Nos. 6358, 6367, 6377, 6379, 6469 of 2023 and 2753 of 2025) filed by various petitioners seeking condonation of delay ranging from 1,098 to 4,058 days in obtaining orders against the State of Maharashtra. The respondents contested the applications but did not specifically dispute the factual averments, and no mala‑fides was inferred. The Court observed that the petitioners were prepared to forgo interest and statutory benefits for the delayed period and identified lapses on the petitioners’ part. Consequently, the Court condoned the delay on the condition that the petitioners would not be entitled to interest or statutory benefits for the period of delay. The applications were thereafter disposed of, with service waived by the respondents and counsel.

Issues considered

  • Whether the Court may condone a delay of up to 4,058 days in civil applications seeking relief against the State.
  • Whether the petitioners can be denied interest and statutory benefits for the period of delay as a condition of condonation.
