Bombay High Court

SHIVAJI S/O. BHANUDAS SALUNKE AND ORS.versusTHE STATE OF MAHARASHTRA THROUGH DISTRICT COLLECTOR, COLLECTOR OFFICE, BEED AND ANR.

Disposal
Admitted/Allowed/Granted/Rule Absolute

Holding

The Court condoned the delay in filing the first appeals, subject to an undertaking by the applicants not to claim any statutory benefit or interest for the delayed period.

Summary

The applicants filed a group of first appeals against the State of Maharashtra, District Collector, Beed, alleging that they had not received compensation and required time to obtain a corrected award. The appeals were filed after a delay of about 1,000 days, which the applicants explained was due to the pending compensation and the need for legal advice. The Court examined whether such a delay could be condoned and found that the explanation removed any inference of intentional delay. Consequently, the Court condoned the delay on the condition that the applicants execute an undertaking not to claim any statutory benefit or interest for the period of delay. The civil applications were allowed, the delay was condoned, and the first appeals were ordered to be registered, with the civil applications disposed of.

Issues considered

  • Whether a delay of approximately 1,000 days in filing first appeals can be condoned under procedural law.
  • Whether the applicants' explanation for the delay negates the presumption of intentional delay.
  • Whether the applicants may be barred from claiming statutory benefits or interest for the delayed period as a condition of condonation.

not appear that the delay is intentional or deliberate. Hence the
delay is condoned in the interest of justice subject to condition
that the applicants – claimants shall give an undertaking before
the Registrar (Judicial) of this Court mentioning that applicants
