Holding
The court condoned the delay in filing the first appeals, subject to an undertaking by the applicants not to claim statutory benefits or interest for the delayed period.
Summary
The applicants filed a group of first appeals against the State of Maharashtra, District Collector, Beed, alleging delays in receiving compensation and seeking correction of award copies. The appeals were filed approximately 1000 days after the original orders, prompting the court to examine whether such delay could be condoned. The applicants explained the delay was due to non‑receipt of compensation, need for advice, and obtaining corrected award copies, and the court found no evidence of intentional delay. Consequently, the court condoned the delay, subject to the condition that the applicants execute an undertaking not to claim any statutory benefit or interest for the delayed period within four weeks. The civil applications were allowed, the delay condoned, and the first appeals were ordered to be registered, with the civil applications disposed of.
Issues considered
- Whether a delay of approximately 1000 days in filing first appeals can be condoned in the interest of justice.
- Whether the explanation provided by the applicants suffices to demonstrate the delay was not intentional.
- Whether imposing a condition of an undertaking not to claim statutory benefits or interest is appropriate when condoning delay.
