Bombay High Court
RAJKUMAR BABRUWAN PATILversusTHE STATE OF MAHARASHTRA AND ANR
- Disposal
- Admitted/Allowed/Granted/Rule Absolute
Holding
The court held that the 1885‑day delay is condonable, allowing the applications, but interest and statutory benefits for the delayed period are not payable.
Summary
The applicants-claimants, whose lands were compulsorily acquired, filed first appeals for enhancement of compensation but delayed filing them by 1885 days. They sought condonation of this delay, arguing that compensation enhancement is a statutory right and should not be defeated on technical grounds. The respondents, the State of Maharashtra and the Union of India, waived service of notice. The court, relying on the precedent of Suresh Kumar v. State of Haryana (2025), allowed the civil applications and condoned the delay, but held that the claimants are not entitled to interest or other statutory benefits for the period of delay. Consequently, the appeals were registered and the applications were permitted.
Issues considered
- Whether a delay of 1885 days in filing first appeals for compensation enhancement can be condoned.
- Whether the statutory right to enhanced compensation can be denied due to procedural delay.
- Whether interest and other statutory benefits are payable for the period of delay.
