The Court condoned the 45‑day delay in filing the appeal, holding that the applicants' reasons were bona fide and not intentional.
Summary
The Sadgurubhau Atmanand Tapovan Trust filed a civil application seeking condonation of a 45‑day delay in filing an appeal against a judgment and award dated 06‑02‑2025 passed by the Joint Charity Commissioner, Nashik Region. The Trust alleged that its inability to file within time was due to lack of legal knowledge and age‑related health problems. The second non‑applicant, though served, did not appear, but the Assistant Public Prosecutor raised no objection to the condonation. The Court examined whether the stated reasons were bona fide and not intentional. Finding the grounds satisfactory, the Court allowed the application and condoned the 45‑day delay, directing the registration of the appeal and its listing for hearing on 25‑03‑2026.
Issues considered
- Whether a delay of 45 days in filing an appeal can be condoned under the provisions of the Civil Procedure Code.
- Whether lack of legal knowledge and age‑related health problems constitute sufficient cause for condonation of delay.
- Whether the non‑appearance of a non‑applicant affects the Court's discretion to condone delay.
