Bombay High Court
VIJAY KISANRAO MUNDE DIED THROUGH LRS ARCHANA VIJAY MUNDEversusTHE MANAGER NEW INDIA INSURANCE COMPANY
- Disposal
- PARTLY ALLOWED AND PARTLY DISMISSED
Holding
The court held that the applicants may withdraw the awarded compensation amount, subject to an undertaking and the balance being kept in a fixed deposit until the appeal is finally decided.
Summary
The applicants filed a civil application seeking to withdraw the compensation awarded by a tribunal in a claim against New India Insurance Company. The insurance company appealed the award but deposited the amount as ordered by the court. The High Court examined the competing interests of the parties and the tribunal's endorsement of the applicants' entitlement. It concluded that allowing the applicants to withdraw the awarded sum, subject to conditions, would balance the interests. Consequently, the court permitted withdrawal of Rs.25,00,000 with accrued interest and ordered the remaining balance to be kept in a fixed deposit for three years pending the final outcome of the appeal.
Issues considered
- Whether the applicants are entitled to withdraw the compensation awarded by the tribunal pending the appeal.
- Whether the court can condition the withdrawal on an undertaking and retain the balance in a fixed deposit.
