The court condoned the 326‑day delay and confirmed the stay order upon receipt of the deposited amount.
Summary
The Executive Engineer (acquiring body) filed a civil application seeking condonation of a 326‑day delay in filing its appeal, citing administrative procedures as the cause of the unintended delay. The court examined the explanation and, finding it satisfactory, condoned the delay and allowed the application as per prayer clause ‘B’, directing that the appeal be admitted after removal of any office objections. In a related application, the applicant confirmed that the entire amount required by the court had been deposited, prompting the court to confirm the earlier stay order. Both applications were consequently disposed of. The judgment underscores the court's willingness to condone procedural delays when justified and to enforce compliance with monetary orders before lifting stays.
Issues considered
- Whether a delay of 326 days in filing an appeal can be condoned under civil procedure.
