Holding

The court allowed withdrawal of the deposited amount, condoned the delay, and confirmed the stay of the compensation order.

Summary

The claimant sought to withdraw the amount deposited by the acquiring body following a court order directing a 50% compensation deposit with interest. The court permitted the withdrawal upon the claimant furnishing a satisfactory undertaking. The acquiring body also sought condonation of a 326‑day delay in filing its application, which the court found neither intentional nor deliberate and therefore condoned. A separate application for a stay of the compensation order was disposed by confirming the earlier ad‑interim stay, as the required deposit had been made. The court issued notice for the first appeal, with both parties waiving service of notice. The record and proceedings were called for further hearing.
