SHREE SAI BABA SANSTHAN TRUST SHIRDI THROUGH ITS CHIEF ACCOUNT OFFICERversusTHE STATE OF MAHARASHTRA

Disposal
DISPOSED OFF

Holding

The Court held that there is no difficulty in allowing the civil application and therefore directed the State to implement the Trust's resolution and approve the proposed budgets.

Summary

The Shree Sai Baba Sansthan Trust, Shirdi, through its CEO, filed a civil application seeking a court order directing the State of Maharashtra to implement Resolution No. 157/3 dated 29‑02‑2025, which proposes crediting additional funds from the Trust Fund to the Management Fund for FY 2025‑26 and approving both the original and revised budgets for FY 2024‑25 and 2025‑26. The respondents, the State and other parties, opposed the direction. The Court examined whether it could intervene in the internal financial decisions of the Trust and found no legal impediment. Consequently, the Court held that there was no difficulty in granting the relief sought. The application was allowed, directing the State to implement the resolution as prayed for.

Issues considered

  • Whether the High Court can direct the State of Maharashtra to implement the Trust's resolution concerning allocation of funds and budget approval.
