Disposal
DISPOSED OFF

Holding

The Court condoned the delay and allowed the amendment to add the legal representatives of the deceased respondent.

Summary

The petitioners sought to amend the writ petition to add the legal representatives of a deceased respondent (respondent no.7) after learning of his death during the pendency of the case. They explained a 306‑day delay in filing the amendment application, attributing it to the time taken to ascertain the heirs' identities. The respondents objected on the ground of delay. The Court, after considering the explanation, exercised its discretion to condone the delay and permitted the amendment to include respondents 7A to 7G as legal representatives, directing that notice be issued to them within two weeks and that the matter be returnable on 16‑09‑2026, with interim relief to continue. The order thus allows the amendment and condones the procedural delay.
