The court condoned the delay and allowed the applicants to withdraw 50% of the deposited compensation amount with interest, keeping the balance in a fixed deposit until further orders.
Summary
The High Court of Bombay entertained several civil applications filed by Champalal Chandmal Samdadiya and others seeking condonation of delay and withdrawal of compensation awarded by a tribunal against the Divisional Controller of MSRTC Dhule. The court, after considering the reasons for delay, allowed the condonation. It also examined the applicants' request to withdraw part of the amount deposited by the appellant, noting that the tribunal had endorsed the applicants' entitlement after hearing both sides. Balancing the competing interests, the court permitted the applicants to withdraw 50% of the deposited amount with accrued interest, subject to an undertaking that disbursement remains pending the final appeal outcome. The remaining balance was ordered to be kept in a fixed deposit for three years, renewable until further orders. The first appeals were admitted, and notice was taken on behalf of the respondents.
Issues considered
- Whether the court should condone the delay in filing the civil applications.
- Whether the applicants are entitled to withdraw the compensation amount deposited by the appellant.
- What proportion of the deposited amount, if any, may be withdrawn pending the final outcome of the appeal.
