Bombay High Court

MANSINGH GENYA GAVIT (DIED) THR LRS. MANILA SUNIL WALVI AND ORS.versusTHE SPECIAL LAND ACQUISITION OFFICER-2, NANDURBAR AND ANOTHER.

Disposal
Admitted/Allowed/Granted/Rule Absolute

Holding

The delay is condoned and the Registrar’s dismissal orders are quashed, restoring the first appeals subject to removal of objections within four weeks.

Summary

The petitioners, a group of land owners, had their first appeals and civil applications dismissed by the Registrar for failing to remove office objections within the prescribed time. They filed composite applications seeking condonation of the delay and restoration of the dismissed appeals. The Court examined whether the procedural lapse could be excused and the dismissal orders set aside. It held that the delay was condonable and quashed the Registrar’s orders, restoring the appeals to their original position. The restoration was conditioned on the petitioners removing all office objections within four weeks, failing which the order would lapse, and the petitioners were not entitled to interest or statutory benefits for the delayed period.

Issues considered

  • Whether the delay in removing office objections can be condoned under the Civil Procedure Rules.
  • Whether the Registrar’s dismissal orders can be set aside and the first appeals restored.

Subjects

  • condonation of delay
  • restoration of appeals
  • civil procedure
