Bombay High Court
CHAMPA NIMBA THAKAREversusTHE SPECIAL LAND ACQUISITION OFFICER 2 NANDURBAR AND ANR
- Disposal
- Admitted/Allowed/Granted/Rule Absolute
Holding
The Court condoned the delay, quashed the Registrar's dismissal orders, and restored the first appeals and civil applications subject to removal of objections within four weeks.
Summary
The petitioners, a group of land owners, had their first appeals and civil applications against the Special Land Acquisition Officer, Nandurbar dismissed by the Registrar for failing to remove office objections within the prescribed time. They filed composite applications seeking condonation of the delay and restoration of the dismissed appeals and applications. The Court examined whether the procedural lapse could be excused in the interest of justice and whether the Registrar's dismissal orders could be set aside. It held that the delay was condonable and that the dismissal orders should be quashed, restoring the appeals to their original position. The restoration was conditioned on the petitioners removing all outstanding office objections within four weeks, failing which the order would lapse, and the petitioners were not entitled to interest or statutory benefits for the period of delay.
Issues considered
- Whether the delay in complying with office objections can be condoned under procedural law
