Holding

The court granted condonation of the 2,845‑day delay in filing the X‑objection as the applicant sought no interest or statutory benefits.

Summary

The applicant filed a civil application seeking condonation of a 2,845‑day delay in filing an X‑objection to a first appeal filed by the State. The applicant argued that no interest or statutory benefits would be claimed for the period of delay. The court considered whether such a lengthy delay could be condoned. Relying on the applicant’s undertaking not to seek any benefit from the delay, the court allowed the condonation. Consequently, the office was directed to register the X‑objection and attach it to the appeal.
