YASHWANT KHATRYA WASAVEversusTHE SPECIAL ACQUISITION OFFICER -2 NANDURBAR

Disposal
Admitted/Allowed/Granted/Rule Absolute

Holding

The Court condoned the delay, quashed the Registrar's order, and restored the appeal and civil application to their original positions.

Summary

The petitioner, Yashwant Khatrya Wasave, sought restoration of a first appeal (No. 17213 of 2023) after the Registrar of the High Court rejected its registration due to unresolved office objections. The petitioner filed a civil application for restoration after a delay of 1,087 days. The Court examined whether such a lengthy delay could be condoned and whether the Registrar's order could be set aside. Relying on the merits of the application, the Court condoned the delay, quashed the Registrar's order, and restored the appeal to its original position, subject to removal of objections within three weeks. The Court also directed that no interest be claimed for the delayed period.

Issues considered

  • Whether a delay of 1,087 days in filing an application for restoration of appeal proceedings can be condoned.

  • Whether the appeal and associated civil application can be restored subject to removal of office objections.
