SAVITA SHIVRAJ KAMBALEversusTHE STATE OF MAHARASHTRA THR ITS SECRETARY AND OTHERS

Disposal
DISPOSED OFF

Holding

The petition is dismissed as the issue is squarely covered by the earlier decision in Writ Petition No. 6549 of 2026.

Summary

Dr. Savita Shivraj Kamble filed a writ petition (No. 2066 of 2020) challenging the non‑performing asset (NPA) status of doctors. The petitioner sought to set aside the interim relief granted to the respondents and to revive the petition. The Court first allowed a civil application to condone the delay in filing. It then restored the writ petition to its original position but dismissed it, relying on the coordinate bench’s earlier decision in Writ Petition No. 6549 of 2026 which had already dismissed a similar claim. The Court ordered that the interim relief continue for six weeks from the date of the order. The dismissal was based on the principle of stare decisis, applying the earlier judgment to the present case.

Issues considered

  • Whether the delay in filing the civil application can be condoned.
  • Whether the petition challenging the NPA status of doctors should be dismissed in view of the earlier decision in Writ Petition No. 6549 of 2026.
  • Whether the interim relief granted earlier should continue pending the final disposal of the petition.
