The Court allowed the petitioner's request and ordered the withdrawal of Rs.5,35,262 with interest to be paid to the petitioner.
Summary
The petitioner, Namdev Ratansing Chafla Rathod, filed a civil application seeking the withdrawal of Rs.5,35,262 deposited by the State of Maharashtra in the High Court pursuant to earlier orders dated 07.04.2026 and 31.07.2026. The petitioner relied on an e‑statement of an award dated 22.02.2022, asserting that the amount, together with interest, should be released to his bank account. The respondents, the State, opposed the withdrawal, contending that the deposit was pending further compliance. The Court examined the terms of the award and the earlier orders and found no legal impediment to the petitioner’s request. Accordingly, the Court allowed the application, directing that the amount with interest be paid to the petitioner and that necessary corrections be made within two weeks.
Issues considered
- What is the appropriate disposition of the amount deposited by the State in the Court pursuant to earlier orders?
