Disposal
DISPOSED OFF

Holding

The Court upheld the compromise and disposed of the appeal and civil application in accordance with the settlement.

Summary

The appellants and respondents reached a compromise, which was verified by the Court's Registrar on 21 September 2026 and recorded as document X‑1. The respondents filed an affidavit (X‑2) confirming that two of the respondents, Gayatri Laxman Dabhade and Aarti Laxman Dabhade, are minors and that the compromise is beneficial to them. The compromise was read out in court and all parties present admitted its contents. The Court, satisfied with the validity of the settlement, ordered that the second appeal and the accompanying civil application be disposed of in accordance with the compromise and directed that a decree be drawn up accordingly. No further adjudication on the merits was required.

Issues considered

  • Whether the compromise entered into by the parties is valid and enforceable, particularly with respect to the rights of the minor respondents.
  • Whether the Court can dispose of the second appeal and the civil application solely on the basis of the parties' settlement.
