The court allowed the withdrawal of 75% of the deposited compensation subject to conditions, condoned the delay, and made the earlier stay absolute.
Summary
Kisan Namdeo Waikar filed a civil application seeking withdrawal of the compensation amount deposited by the State of Maharashtra in the reference court after a stay of execution was granted. The court permitted the claimant to withdraw 50% of the amount upon furnishing a standard undertaking, an additional 25% upon providing a solvent security, and directed that the remaining 25% be placed in a fixed deposit for two years. A separate application for condonation of delay was filed, and the court, relying on the Supreme Court’s decision in Sheo Raj Singh v. Union of India, allowed the condonation and ordered the appeal to be registered. Another application sought to make the earlier stay absolute, which the court granted. All applications were allowed, and the stay was made absolute.
