ARJUN SHILANATH GANGARDEversusAJIT BALASAHEB KUMBHAR CHIEF EXECUTIVE OFFICER

Disposal
DISPOSED OFF

Holding

The contempt petition was dismissed as nothing survived in it.

Summary

Arjun Shilanath Gangarde filed a contempt petition (No. 116 of 2020) challenging his transfer in 2019 by the Chief Executive Officer, Ajit Balasaheb Kumbhar. The petitioner sought time to take instructions, but the Court observed that the transfer order was several years old and that subsequent transfers may have occurred. Consequently, the Court found that the petition no longer had any surviving basis. The judges held that the petition could not proceed and ordered its disposal. The petition was therefore dismissed as there was nothing left to adjudicate.

Though the learned counsel for the petitioner

seeks time to take instructions, but on going through the

order under contempt it appears that it is in respect of

transfer of the petitioner in the year 2019. As such, by

passage of time, there might be subsequent transfers also. As

such, nothing survives in this Contempt Petition and the

                 same stands disposed of.
