SAYYED TAHERODDIN SAYYED GAUS MOHIYODDINversusUDDHAV SANDIPAN BHORE AND OTHERS

Disposal
DISPOSED OFF

Holding

Since the underlying civil suit was disposed, the contempt petition stood disposed as there was nothing left to enforce.

Summary

The petitioner filed a contempt petition alleging violation of a status‑quo order dated 23‑01‑2013 and 07‑01‑2014 passed by this Court. The underlying dispute arose from a writ petition that challenged an order of the District Judge‑3, Ambajogai, which in turn confirmed an earlier order of the Civil Judge, Senior Division, Ambajogai in Regular Civil Suit No. 157/2013. That civil suit was finally disposed by the Civil Judge on 24‑07‑2015. Because the suit was fully disposed, there was no longer any operative order to be contravened. The Court held that the contempt petition could not proceed and therefore stood disposed. The petition was dismissed as moot.
