Bombay High Court

DATTARAYA GOKUL JADHAVversusTHE STATE OF MAHARASHTRA AND OTHERS

Disposal
DISPOSED OFF

Holding

The contempt petition stands disposed as there is nothing left to enforce following the disposal of the underlying appeal.

Summary

The petitioner filed a contempt petition challenging a district court order dated 12 March 2013, which had been the subject of a writ petition that the High Court had earlier disposed of on 3 September 2013, granting a status‑quo and directing the appeal to be decided within nine months. The respondent argued that the regular civil appeal (No. 62 of 2013) had subsequently been disposed of by the district judge. The High Court observed that, with the disposal of the underlying appeal, there was no longer any operative order to be disobeyed, and therefore the contempt petition could not survive. Consequently, the court held that the contempt petition stands disposed. The petition was dismissed without any further order.
