Bombay High Court

BHASKAR CHAGANRAO SURYWANSHIversusTHE STATE OF MAHARASHTRA AND ORS

Disposal
DISPOSED OFF

Holding

The contempt petition stands disposed as the underlying interim order no longer exists.

Summary

The petitioner, Bhaskar Chaganrao Surywanshi, filed a contempt petition (No. 17 of 2009) alleging contempt of an interim order passed in writ petition WP/2713/2007. The High Court later disposed of the writ petition on 10 April 2014, effectively nullifying the interim order. The court examined whether the contempt petition could survive after the underlying order was no longer in force. It held that with the disposal of the writ petition, the basis of the contempt allegation vanished. Consequently, the contempt petition was dismissed as there was nothing left to adjudicate.

Issues considered

  • Whether a contempt petition remains maintainable when the order alleged to be contemptuous has been vacated or the parent writ petition is disposed.
