JAISHRI W/O.GUNWANTRAO PATIL AND OTHERSversusSMT.MAHADABAI GUNWANTRAO PATIL AND OTHERS

Disposal
DISPOSED OFF

Holding

The contempt petition stands disposed as no surviving order exists to be contravened.

Summary

The petitioners filed a contempt petition alleging that the respondents violated an interim status‑quo order issued in a writ petition. The writ petition was later disposed on 7 April 2011 after the parties reached a compromise, and the interim relief was vacated. The court examined whether any cause of contempt remained after the underlying order was set aside. It held that, with the interim order no longer in force, there was nothing left to sustain the contempt petition. Consequently, the contempt petition was disposed of.

                 P.C. :

                 1. None of the petitioners.
                 2. The order of which the contempt is alleged was an
interim order of status-quo in Writ Petition.
                 3. Subsequently, by order dated 7th April, 2011, the
Writ Petition itself is disposed of in view of the compromise
between the parties. The compromise pursis was also placed
on record and there is order of vacating interim relief while
                 disposing of the Writ Petition.
                 4. As such, nothing survives in the contempt
petition and the same stands disposed of.
