Bombay High Court

M/S WELWORTH TRAVELS AND ANRversusSHRI VINAY SATYANARAYAN LOYA

Disposal
DISPOSED OFF

Holding

The contempt petition stands disposed as the interim order on which it was founded was vacated.

Summary

The petitioners, M/s Welworth Travels and others, filed a contempt petition (199 of 2009) challenging an interim order passed in Writ Petition No. WP/5018/2008. The High Court, while disposing of the writ petition on 26 November 2009, vacated the interim order that formed the basis of the contempt proceedings. The court observed that with the vacating of the interim order, there was no longer any operative order to be disobeyed or contravened. Consequently, the contempt petition could not survive and was ordered to stand disposed. The order also indicated that any related civil application, if pending, would be disposed of along with the contempt petition.
