Bombay High Court

BHUSAWAL MUNICIPAL PENSIONERS ASSOCIATION BHUSAWAL THR PRESIDENT SURESH LAXMAN PATILversusANIL JAGTAP, CHIEF EX OFFICER BHUSAWAL MUNICIPAL COUNCIL AND ORS

Disposal
DISPOSED OFF

Holding

The contempt petition is disposed as nothing survives in view of the Supreme Court's modification and the petitioner's inactivity.

Summary

The petitioners, represented by the President of the Bhusawal Municipal Pensioners Association, filed a contempt petition challenging an order of the High Court. The Supreme Court, in an order dated 8 July 2014, modified the original contempt order. The petitioners failed to pursue the matter after 2013. Considering the Supreme Court's modification and the petitioners' inactivity, the High Court found that no issue remained for adjudication. Consequently, the contempt petition was disposed of.

Issues considered

  • Whether the contempt petition remains maintainable after the Supreme Court modified the original contempt order
  • Whether the petitioner's failure to prosecute the petition after 2013 warrants dismissal of the contempt petition

Subjects

  • contempt of court
  • Supreme Court modification
  • petitioner's inactivity
