SHAILAJA UTTAMRAO PATILversusRAJARAM MANE
- Disposal
- DISPOSED OFF
Holding
The petition was held to be infructuous and therefore disposed of.
Summary
The petitioner, Shailaja Uttamrao Patil, filed a contempt petition alleging disobedience of a 2012 order that directed her transfer within a 30 km radius for the convenience of her couple. The order was issued by the trial court and the petitioner allegedly failed to comply. The High Court examined whether the alleged non‑compliance constituted contempt and whether the petition remained viable after the lapse of time. The Court observed that the subject matter of the petition had become infructuous due to the passage of time. Consequently, the Court disposed of the petition without further proceedings.
Issues considered
- Whether the petitioner’s alleged failure to comply with the 2012 transfer order amounts to contempt of court.
- Whether the contempt petition remains maintainable given the lapse of time rendering the subject matter infructuous.
