Bombay High Court
ASHOK DNYANOBA CHAVAN AND ORSversusSTATE OF MAHA AND ANR
- Disposal
- DISPOSED OFF
Holding
The contempt petition was dismissed as no cause of action survived after the disposal of the writ petition.
Summary
The petitioners filed a contempt petition seeking enforcement of an interim order issued in a writ petition (WP/5747/2004). The writ petition, however, was disposed of on 20 June 2017, rendering the interim order moot. The court examined whether any cause of action remained for the contempt petition after the disposal of the underlying writ. It held that with the disposal of the writ petition, there was nothing left to enforce and consequently no ground for contempt proceedings. Accordingly, the contempt petition was dismissed, with the court granting liberty to the petitioners to approach the appropriate forum if any direction from the writ petition remains unimplemented. The order was pronounced by Judges Sandipkumar C. More and Vaishali Patil‑Jadhav on 16 September 2026.
