Bombay High Court

SAJABAI NAKU MANURE AND ANRversusSHEETAL UGALE AND OTHERS

Disposal
DISPOSED OFF

Holding

The Court held that due to the petitioners' inaction and abandonment of the proceedings, the contempt petition stands disposed.

Summary

The petitioners, Sajabai Naku Manure and others, filed a contempt petition alleging that an order directing their names be added to the beneficiary list of the Indira Awas Yojana had been disobeyed. The Court noted that the Resource Personnel report showed the petitioners had made no effort to pursue the matter after 2013 and were not diligent in advancing the contempt proceedings. The Court observed that the alleged order required the Project Director of the District Rural Development Agency to include the petitioners' names as beneficiaries. Given the passage of time and the petitioners' inaction, the Court found that there was nothing left to adjudicate in the contempt petition. Consequently, the petition was disposed of without any further order.

Issues considered

  • Whether the petitioners' failure to actively pursue the contempt petition amounts to abandonment rendering the petition non‑maintainable
  • Whether the order directing addition of the petitioners' names to the Indira Awas Yojana beneficiary list was complied with

Subjects

  • contempt of court

          PER COURT :
          1. None for the petitioners.
          2. The report of the Resource Personnel of this Court indicates that
after 2013, the petitioners have not circulated the matter and have not
been diligent in pursuing the present contempt petition.
          3. In any event, in the order alleged to have been disobeyed, it was
directed that the names of the petitioners be added to the list of
beneficiaries under the Indira Awas Yojana prepared by the Project
          Director, District Rural Development Agency.
          4. With the passage of time and in absence of any steps taken by the
petitioners to pursue the matter, nothing survives in the present
contempt petition and the same stands disposed of.
