KIRAN PRAKASH JADHAVversusTHE STATE OF MAHARASHTRA AND OTHERS
- Disposal
- DISPOSED OFF
Holding
The contempt petition is dismissed as nothing survives in it.
Summary
The petitioner, Kiran Prakash Jadhav, filed a contempt petition against the State of Maharashtra seeking enforcement of an earlier order directing the closure of unauthorized schools. The court had ordered that such schools not be allowed to operate from the academic year 2013‑2014 based on a statement by the Deputy Education Officer. Respondents 2‑4 filed an affidavit‑in‑reply stating that the Maharashtra Government, under the Maharashtra Self‑Financed Schools (Establishment and Regulation) Act, 2012, had subsequently granted permission to a respondent to run a self‑financed school. In view of this policy change, the court held that the basis of the contempt petition no longer existed. Consequently, the petition was dismissed as there was nothing left to contend. The matter was therefore disposed of.
Issues considered
- Whether the contempt petition remains maintainable after the Government granted permission to operate a self‑financed school under the Maharashtra Self‑Financed Schools (Establishment and Regulation) Act, 2012.
