Bombay High Court

KUNDLIK KISAN GHUGEversusTHE STATE OF MAHARASHTRA AND OTHERS

Disposal
DISPOSED OFF

Holding

The contempt petition is dismissed for non‑prosecution.

Summary

The petitioner, Kundlik Kisan Ghuge, filed a second contempt petition in 2013 alleging that a prior court order had not been complied with. The High Court had earlier allowed the petitioner to revive the contempt petition if the order was not fully complied with. After notice was issued in the present petition, the petitioner failed to circulate the matter or show any diligence in pursuing the petition or securing compliance. The Court observed that the petitioner had effectively abandoned the proceedings. Consequently, the Court dismissed the contempt petition on the ground of non‑prosecution.

          2. The present contempt petition is the second round of proceedings.
In the earlier round of the contempt petition, this Court had passed an
order recording that the order alleged to have been disobeyed had been
complied with by granting liberty to the petitioner to revive the
