Bombay High Court
ASHWINI KESHAVRAO KADAM AND OTHERSversusDINKAR TEMKAR THE DIRECTOR OF EDUCATION PRIMARY MAHARASHTRA STATE PUNE
- Disposal
- DISPOSED OFF
Holding
The contempt petition is dismissed as there is no ground for contempt after the Director's order effecting the postings.
Summary
The petitioners filed a contempt petition seeking direction that they be posted to vacant posts of the Zilla Parishad, Ahmednagar, after the Education Officer communicated to the Director of Education (Primary) that their documents should be scrutinized and postings granted. The Director subsequently issued an order appointing petitioner No.1, and the communication indicated that the other two petitioners should also receive postings. The Court examined whether the petition remained viable in view of the Director's order and the communication. It held that the order effectively satisfied the petitioners' demand, rendering the contempt petition moot. Consequently, the Court disposed of the petition, finding nothing to entertain.

P.C. :
1. Though learned counsel for the petitioners has
been elevated as Judge of this Court but learned A.G.P.
placed on record the copy of communication dated
08.12.2025 issued by the Education Officer (Primary), Zilla
Parishad, Ahilyanagar to the Director of Education (Primary),
Pune mentioning that all these petitioners are considered for
giving posting on the vacant posts of Zilla Parishad,
Ahmednagar. Accordingly, the direction is also given for
scrutinizing their documents and to give them posting.
2. Further it appears that petitioner no.1 has also
appointed and her appointment letter is also placed along
with the communication. Thus, it appears that in view of the
order passed by the Director of Education (Primary), the
other two petitioners also must have been given posting

pursuant to the order under contempt. As such, nothing
