Holding

The contempt petitions are disposed of as the petitioners failed to appear and there is no dispute that the respondents complied with the earlier court order.

Summary

The High Court heard two contempt petitions (CP No.618 of 2025 and CP (Stamp) No.21283 of 2025) arising out of Writ Petition No.11390 of 2023 and Writ Petition No.4390 of 2023 respectively. The petitioners failed to appear on three successive dates despite the court’s earlier order dated 11 March 2025 being complied with by the respondents, as affirmed in an affidavit. The respondents, represented by counsel, submitted that compliance with the November 3, 2025 order was not contested. Since the petitioners did not appear, the court found no ground to proceed with the contempt proceedings. Consequently, both contempt petitions were disposed of. No substantive legal question beyond procedural compliance was addressed.

Issues considered

  • Whether the petitioners’ non‑appearance constitutes contempt of court.
  • Whether the contempt petitions should be dismissed on the ground of petitioners’ failure to appear despite compliance with the earlier court order.

Subjects

  • contempt of court
  • non‑appearance
  • compliance with order
  • writ petition
