Bombay High Court

Bhagwan Dhondiram DhumalversusRanjit Singh Deol

Disposal
Disposed Off

Holding

The contempt petition stands disposed of as not pressed because the respondent has satisfied the payment order.

Summary

The petitioner, Bhagwan Dhondiram Dhumal, filed a contempt petition seeking enforcement of a prior order directing the respondent school to pay pension and retirement gratuity amounts totaling Rs.78,880. The Educational Officer of Zilla Parishad affirmed that the amounts were calculated and that the school was ordered to pay them. The respondent, represented by counsel for respondents Nos. 4, 5 and 6, produced two cheques for the full amount, which the petitioner’s advocate accepted. Upon receipt of the payment, the court examined whether the contempt petition remained viable. The court held that, since the statutory demand had been satisfied, the contempt petition was no longer pressed and therefore disposed of. The judgment underscores that a contempt proceeding ceases when the alleged breach is remedied.
