Bombay High Court

SHARAD KHUSHAL DEOREversusTHE STATE OF MAHARASHTRA AND OTHERS

Disposal
DISPOSED OFF

Holding

The contempt petition is dismissed as there is nothing left to enforce after the original writ petition has been finally disposed and relief granted.

Summary

Sharad Khushal Deore filed Contempt Petition No. 918 of 2018 alleging that the State of Maharashtra and others had violated interim orders issued in the earlier Writ Petition (WP/3930/2016). The Court examined whether the contempt petition could survive after the original writ petition was finally disposed and relief was granted. It observed that the final order dated 23 June 2021 in the related writ petitions, including the one in which the petitioner was a party, had already provided the relief sought. Consequently, there was no pending order to enforce and no ground for contempt. The Court therefore disposed of the contempt petition without granting any relief to the petitioner.
