Disposal
DISPOSED OFF

Holding

The High Court may direct a Wakf Tribunal to decide a pending suit within a specified period to prevent undue delay.

Summary

The petitioners, Peoples’ Education Society, filed a civil revision seeking direction for the speedy disposal of Wakf Suit No.197 of 2017 pending before the Wakf Tribunal, Aurangabad since 2017. The respondents, Maharashtra State Board of Wakf, opposed the revision but did not contest the need for expeditious disposal. Both parties agreed that the suit had been pending for more than eight years, warranting judicial intervention. The Court, after hearing counsel, noted the undue delay and the public interest in timely resolution of Wakf matters. With the consent of both sides, the Court disposed of the revision and directed the Wakf Tribunal to decide the suit within eighteen months from the date of the order. The direction aims to ensure that the pending suit is concluded without further unnecessary postponement.
