VANITA ARJUN PATILversusKRUSHNA RAU KURANE AND ANR.

Disposal
Dismissed as Withdrawn

Holding

The revision application was withdrawn and the court disposed of it as withdrawn.

Summary

The applicant, Vinita Arjun Patil, filed Civil Revision Application No. 434 of 2025 seeking to quash the order dated 03/07/2025 passed by the Civil Judge Senior Division, Kolhapur, in Special Civil Suit No. 438/2023 and to have the suit dismissed with costs. The applicant's counsel, Mr. Himanshu Pujari, later moved the court for leave to withdraw the revision application. The court considered the request and, noting the applicant's intention to withdraw, granted leave for withdrawal. Consequently, the revision application was disposed of as withdrawn. No substantive merits of the original order were examined as the application was withdrawn before adjudication.

Issues considered

  • Whether a civil revision application seeking to set aside a lower court order may be withdrawn by the applicant.
  • Whether the court should entertain the request to quash the order dated 03/07/2025 in Special Civil Suit No. 438/2023.

Subjects

  • civil revision
  • withdrawal of application
  • procedural law
  • order set aside
