Bombay High Court

THE STATE OF MAHARASHTRAversusSHRI SOMANNA S. PATIL AND OTHERS

Disposal
Disposed Off

Holding

The revision application was dismissed because the amount awarded was considered meagre, and the court is not inclined to entertain such proceedings.

Summary

The State of Maharashtra filed a civil revision seeking to set aside an order of the Civil Judge, Senior Division, Pandharpur, which awarded a modest sum of Rs.15,787.12 to the respondents. The revision challenged the award on the ground that the amount was meagre. The High Court, relying on its consistent practice, held that it is not inclined to entertain revision applications where the monetary claim is trivial. The court emphasized that the dismissal was not on the merits of the case and would not affect other revisions involving larger sums. Consequently, the revision application was dismissed and the respondents were directed to be notified to take steps regarding the deposited amount.
