The court amended the cause title, permitted compounding of the Section 138 offence, quashed the earlier judgments, and directed release of the deposited compensation to the respondent, waiving costs.

Summary

Narayan Singh, incarcerated in Sada Jail, and his wife filed a criminal revision seeking amendment of the case title after the respondent company changed its name from Crompton Greaves Ltd. to Crompton Greaves Consumer Electricals Ltd. The court allowed the amendment, accepted the respondent’s consent to compound the offence under Section 138 of the Negotiable Instruments Act, and consequently set aside the earlier judgments dated 03‑06‑2013 and 10‑06‑2015. It ordered the compensation amount deposited by the applicant to be released to the respondent company, with any accrued interest, and waived the statutory cost payment to the Goa State Legal Services Authority. The revision application was thereafter disposed.

Issues considered

  • Whether the cause title may be amended to reflect the respondent’s change of name.
  • Whether the offence under Section 138 of the Negotiable Instruments Act can be compounded with the respondent’s consent.
  • Whether the earlier judgments in the criminal case and appeal should be quashed.
  • Whether the compensation deposited by the applicant should be remitted to the respondent.
