Bombay High Court

RADHIKA R. PANGAMversusVISHAL AVADHUT ZUWARKAR

Disposal
Allowed

Holding

The court allowed the withdrawal of the part of compensation deposited by the applicant, with interest, as the revision was disposed and the applicant had died.

Summary

The applicant, Radhika R. Pangam, died on 20 February 2025, and the related Criminal Revision No. 69/2006 was disposed on 4 July 2026. Respondent No.1, Vishal Avadhut Zuwarkar, sought to withdraw a portion of the compensation amount (Rs. 3,00,000) that the applicant had deposited during the pendency of the revision proceedings. The court noted that the total compensation due was Rs. 8,80,000, of which only Rs. 3,00,000 had been deposited for interim relief. Considering the applicant's death and the disposal of the revision, the court found it just to permit the withdrawal of the deposited amount along with accrued interest. It ordered that the remaining compensation be recovered from the applicant’s legal heirs and dismissed the application as disposed.

                    CORAM:- AMIT S. JAMSANDEKAR, J.
                    DATED :- 29th September, 2026

P.C.

Heard Mr. P. Sawant, learned Counsel for the Applicant.

2. It is pointed out that Criminal Revision No. 69/2006 came to be
disposed of by order dated 04.07.2026, in view of the fact that the
Applicant had expired on 20.02.2025.

3. By the present application, Respondent No.1 seeks withdrawal
of part of the compensation amount deposited by the Applicant
during the pendency of the Criminal Revision proceedings.

4. I find that the Applicant is justified in seeking withdrawal of the
said amount, particularly in view of the fact that the total
compensation payable by the Applicant was Rs.8,80,000/-, whereas
the Applicant had deposited only a sum of Rs.3,00,000/- before this
Court for securing interim relief in favour of the Applicant.

5. In view of the disposal of the Criminal Revision Application, I
find it just and appropriate, in the interest of justice, to permit
Respondent No.1 to withdraw the part amount of compensation
deposited by the Applicant.

6. Accordingly, the application is allowed. Applicant is
permitted to withdraw said part payment made together with the
accrued interest. Learned Counsel for Respondent No.1 has
furnished the bank details, which are taken on record.

7. The application stands disposed of.

8. Mr. Menezes, learned Counsel appearing for the Applicant in
the revision application, submits that, in view of the fact that the
Applicant expired on 20.02.2025, he is no longer representing the
Applicant.

9. As regards the remaining compensation amount, learned

Counsel submits that Respondent No.1 shall adopt appropriate
proceedings against the legal heirs of the Applicant for recovery of
                       the same.
