The court allowed the relaxation of the bail condition restricting the applicant from entering Mandrem village.

Summary

Vidhyadhar Ramesh Pokhre was granted bail in a criminal case for assaulting a victim, with a condition that he not enter the village of Mandrem until trial completion. He applied to have this condition relaxed, asserting full compliance with all bail terms, attendance at all court dates, and hardship to his business caused by the restriction. The prosecution opposed, emphasizing the condition’s purpose of protecting the victim’s safety. The court observed that the applicant had adhered to the bail conditions, that charges had not yet been framed, and that there was no evidence of prejudice to a fair trial. Consequently, the court permitted the relaxation of the restriction on entering Mandrem, while maintaining the remaining bail conditions. The application was therefore allowed.

Issues considered

  • Whether the bail condition prohibiting the applicant from entering Mandrem village should be relaxed.
  • Whether the applicant's compliance with bail terms and the pending framing of charges justify modification of the bail condition.

Subjects

  • bail
  • modification of bail conditions
  • criminal procedure
  • victim protection
  • trial delay
  • court order
