Bombay High Court
DILIP TULSHIRAM PATILversusTHE SPECIAL LAND ACQUISITION OFFICER, U.T.P.H-3, JALGAON AND ORS
- Disposal
- PARTLY ALLOWED AND PARTLY DISMISSED
Holding
The Court partially allowed the appeals and modified the compensation in accordance with the rates and principles laid down in First Appeal No. 813 of 2023.
Summary
The appellants, a group of landowners from several villages, appealed the 2017 compensation awards granted by the Joint Civil Judge in respect of land acquired in 2003 for the M.I. Tank project in Jalgaon. They contended that the awards were insufficient and sought higher compensation. The High Court noted that a coordinate bench had already decided similar matters in First Appeal No. 813 of 2023, which addressed the same acquisition proceedings. Relying on that precedent, the Court partially allowed the appeals and modified the compensation rates to Rs 12,00,000 per hectare for irrigated land, Rs 6,00,000 per hectare for jirayat land, Rs 3,00,000 per hectare for pot‑kharab, and 80% of the valuation report for fruit‑bearing trees. The Court also affirmed entitlement to statutory benefits, interest from the date of award, and the possibility of claiming rental compensation. The remaining portions of the original award were left unchanged.
Issues considered
- What compensation rates should apply to land acquired under the 2003 project?
- Whether the coordinate bench decision in First Appeal No. 813 of 2023 is binding on the present appeals?
- Whether the appellants are entitled to statutory benefits, interest, and rental compensation under the applicable land acquisition law?
