Bombay High Court
PRALHAD TRAMBAK PATILversusTHE SPECIAL LAND ACQUISITION OFFICER, U.T.P.H-3, JALGAON AND ORS
- Disposal
- PARTLY ALLOWED AND PARTLY DISMISSED
Holding
The Court partially allowed the appeals, modified the compensation as per the rates specified, and granted statutory benefits, interest, and the right to claim rental compensation.
Summary
A group of landowners appealed the 2017 awards of the Joint Civil Judge, which had refused to enhance compensation for land acquired under a 2003 project. The High Court noted that the appeals were connected to the same acquisition project as earlier appeals decided in First Appeal No. 813 of 2023. Relying on that coordinate‑bench decision, the Court partially allowed the appeals and fixed new compensation rates: Rs 12,00,000 per hectare for irrigated land, Rs 6,00,000 per hectare for jirayat land, Rs 3,00,000 per hectare for pot‑kharab, and 80 % of the valuation report for fruit‑bearing trees. The Court also ordered payment of all statutory benefits, including interest as laid down in State of Maharashtra v. Kailash Shiva Rangari, and allowed claim for rental compensation. The modified award was to replace the earlier one, while the remainder of the award was left unchanged.
Issues considered
- Whether the compensation awarded in 2017 should be enhanced in line with the coordinate‑bench decision in First Appeal No. 813 of 2023.
- What rates of compensation are applicable to irrigated, jirayat, and pot‑kharab land, and to fruit‑bearing trees.
- Whether the appellants are entitled to statutory benefits, interest, and rental compensation under the applicable land acquisition law.
