- Disposal
- PARTLY ALLOWED AND PARTLY DISMISSED
Holding
The appeals are dismissed in terms of the order dated 12 August 2026 passed in First Appeal No. 281 of 2012.
Summary
The Acquiring Body, represented by the Executive Engineer of the Sina‑Kolegaon Medium Project, filed multiple first appeals challenging judgments and awards of various Land Acquisition Reference Courts concerning land taken from the villages of Domgaon and Sonari for the same public purpose. The appellants argued that the controversies were identical to those decided in an earlier order of this Court dated 12 August 2026 in First Appeal No. 281 of 2012, which dismissed similar appeals by the Acquiring Body. The State of Maharashtra, through its Advocate‑General, conceded that the matters were indeed covered by the earlier decision. The Court examined whether the earlier precedent applied and found no reason to depart from it. Consequently, the Court dismissed all the present appeals in accordance with the earlier order, and any civil applications were also disposed of.
Issues considered
- Whether the controversies raised in the present first appeals are identical to those decided in First Appeal No. 281 of 2012.
- Whether the earlier order dismissing similar appeals is binding on the present appeals.
- Whether the present appeals should be dismissed on the basis of the earlier precedent.
Subjects
- land acquisition
- public purpose
- precedent

- acquisition of land

3. The present appeals are filed by the Acquiring Body challenging the
Judgments and Awards dated 29.01.2010, 22.03.2011, 14.06.2011,

16.04.2011 and 29.03.2010 passed by the learned Reference Court in Land
Acquisition Reference Nos. 82 of 2006, 26 of 2007, 711 of 2001, 713 of
2001, 750 of 2001, 728 of 2001, 744 of 2001, 758 of 2001, 72 of 2006, 747

4. The learned counsel for the appellant-Acquiring Body as well as the

12.08.2026 passed by this Court in First Appeal No. 281 of 2012 (The
Executive Engineer, Minor Irrigation Division, Osmanabad Vs. The State of
Maharashtra and Others) and connected matters. It is submitted that the
lands of the claimants in the present appeals were acquired from the same
villages, namely, Domgaon and Sonari, for the same public purpose, i.e.
Sina-Kolegaon Medium Project, and under the same notifications as involved
in the aforesaid appeals. It is, therefore, submitted that the controversy
involved in the present appeals is squarely covered by the aforesaid order
dated 12.08.2026 passed by this Court in First Appeal No. 281 of 2012

(supra) and connected matters, wherein the appeals filed by the Acquiring
