Bombay High Court

MAHARASHTRA KRISHNA VALLEY DEVELOPMENT CORPORATIONversusTHE STATE OF MAH and ANR

Disposal
DISMISSED

Holding

The appeals are dismissed and the Reference Court's award stands.

Summary

The Maharashtra Krishna Valley Development Corporation appealed the judgment and award dated 18 June 1994 passed by the Reference Court in L.A.R. Nos. 26/1992, 341/1993 and 266/1992, contending that the compensation awarded exceeded four times the amount granted by the State Land Acquisition Officer (SLAO). The State of Maharashtra relied on Government Resolution No. Sankirna-2014/Prak.Kra.4/Bham-1/A-4 dated 3 November 2016, as amended, which stipulated that the State would not challenge the reference award provided the compensation was enhanced only up to four times. The learned counsel for the appellant argued that the award was within the four‑times limit, while the State argued otherwise. The Court examined the resolution and found no basis to intervene in the reference court's award. Consequently, the Court dismissed the appeals and ordered the pending civil applications to be disposed of.

Issues considered

  • Whether the compensation awarded by the Reference Court exceeds the four‑times limit prescribed by the State Government's resolution.
  • Whether the High Court should intervene and set aside the Reference Court's award.

Subjects

  • compensation
  • reference court

P. C.:

1. Heard the learned counsel for the Appellant.
