- Disposal
- DISMISSED
Holding
The Court dismissed all the appeals and disposed of the pending civil applications, adopting the view expressed in First Appeal No.694 of 2004.
Summary
The High Court of Bombay (Aurangabad Bench) heard several appeals challenging compensation awards in land acquisition proceedings dating back to 1993 for the establishment of a MIDC at Latur. The appellants contested judgments and awards dated 2004 and 2006, arguing that the compensation determinations were erroneous. The Court noted a prior decision in First Appeal No.694 of 2004 arising from the same acquisition, which had set a precedent on the matter. Aligning with that earlier view, the Court dismissed the present appeals and also disposed of pending civil applications and any cross‑objections. Consequently, the earlier compensation awards were left undisturbed and the litigation was brought to an end.
Issues considered
- Whether the compensation awards in the 1993 MIDC acquisition proceedings were correctly determined.
- Whether the earlier judgments and awards should be set aside in light of the precedent established in First Appeal No.694 of 2004.
- Whether the pending civil applications related to the acquisition should be entertained or disposed.
