Bombay High Court

THE STATE OF MAHARASHTRAversusANITA SOJAR ANDHARE AND ANR

Disposal
DISMISSED

Holding

The appeal is dismissed as the compensation enhancement does not exceed four times the original award, in line with the Government resolution.

Summary

The State of Maharashtra appealed a 2014 judgment of the 2nd Joint Civil Judge Senior Division, Osmanabad, which had enhanced compensation in a land acquisition case. The State argued that the reference court’s enhancement did not exceed four times the amount awarded by the Land Acquisition Officer. The Court considered the State Government’s policy resolution (Resolution No. Sankirna‑2014 and its corrigenda) which states that the State will not challenge a reference if the enhancement is only up to four times. Finding no ground to intervene, the Court dismissed the appeal. Consequently, the claimant may withdraw any amount deposited with the acquiring authority, and any pending civil applications are disposed of.

Issues considered

  • Whether the State can challenge the reference court’s enhanced compensation when it does not exceed four times the amount awarded by the Land Acquisition Officer.
