Bombay High Court

STATE OF MAHAversusMADHUKAR KISHAN JAGTAP DIED LRS

Disposal
PARTLY ALLOWED AND PARTLY DISMISSED

Holding

The Court held that the order should be corrected to insert the reference to section 28 of the Act.

Summary

The State of Maharashtra appealed a conviction of Nilkantrao Apparão Patil, and a subsequent order dated 24 August 2026 was issued by the Court. The respondent's counsel, Mr. S.V. Mundhe, moved the Court to correct the minutes of that order, pointing out that the phrase ‘under section 28 of the Act’ was omitted after the word ‘interest’ in paragraph 5 and clause (ii) of the operative part. The Court examined the submission and found that the omission was a clerical error that required rectification. Accordingly, the Judge ordered that the correction be made and the revised order be uploaded, with any copies deemed corrected. The motion for correction was therefore disposed of.
